I am glad the hate law did not pass. We can charge people for crimes as we always have. People are always prejudice and racist throughout life. A crime is a crime. Assault is a crime. If somebody assaults somebody because they are gay, they are charged with assault. We do not need hate crime legislation. The already charges people with crimes if the commit crime upon another person. This new law would give too much power to the State and government. This new law would get carried away and not really protect anybody. It is unnessary.

First of all, I'm not a lawyer so my reasoning on this could be completely misinformed. But couldn't hate crime legislation potentially lead to an abuse of one's constitutional rights by allowing prosecutors to get around double-jeopardy?

Scenario: A man is tried for murder. The victim is of a different race/religion/sexual orientation. He is tried by his state of residence for murder and acquitted. Then the federal government looks at the case, decides that the murder was motivated by hate, classifies it as a "hate crime" and then tries the suspect in federal court.

Double jeopardy? Most people would think so. But would an overzealous prosecutor? What would a federal judge say? Could it depend on the political leanings of the judge?

So let's say the defendant appeals and the federal judge rules that while he cannot be tried again for murder, he could be tried for hate. You have no act of violence on which to hang a "hate crimes" charge because the defendant has already been acquitted of murder.

So does the federal government have the right to try the suspect for murder (as a "hate" crime) since he wasn't tried for a "hate" crime before?

Hate crime legislation IS thought crime legislation by its very definition. And you are completely correct that it is not about the race or sexuality of the victim, it is about the thoughts (motivation) of the perpetrator. And that is why it's unfair. It's also why it's ineffective. Is the life of someone that was killed because he or she had something that a perpetrator wanted worth less than that of someone that was gay? Clearly not. So why should the two crimes be treated differently? If you really wanted to, you could say that hate crime legislation gives special treatment to non-hate inspired murderers. And that doesn't make any sense, either. Besides, anyone that would assault someone and/or kill someone based on hate is not going to be dissuaded from doing so because of hate crime legislation. Even without the hate aspect, they still face the stiffest penalty our criminal justice system metes out. Bottom line, everyone that is assaulted or killed by anyone should be treated with the same level of justice. It should matter if that person was killed because they were black or if they were killed because they had a nice car that some douchebag wanted. The end result is that the person was killed. And the full force of the criminal justice system should be brought to bear on the perp.

I don't know if he took a video professor course on writing, but I keep finding myself agreeing with Chris Haire lately. The confederate monument is a memorial to hundreds of thousands of American war dead. They fought under that flag... regardless of their leaders intentions, they represented the general population and not the aristocracy. We have a large Vietnam War memorial in DC, representing the our fallen warriors from a lost war and a lost cause. There is nothing wrong with honoring your fellow citizens' sacrifice on public land, even when the politicians of the time failed them.

However, if the reactionaries in the 60s hadn't used the confederate flag's placement atop the state house to champion against civil rights, then it wouldn't continue to carry that message in this context. This symbol was co-opted not by fringe groups but by our very own state as a symbol of oppression, a mere generation ago. And as you can see in this thread, there are still those that follow that beacon they lit in the 60s.
So this is a sort of misleading event. Pauly Shore doesn't do any of his stand up, he is only there as a host. He interacts a bit with the crowd and staff a bit then disappears for awhile and comes back to get the patrons to tip the entertainers. The Pierce was funny and is worth seeing, but not near a long enough set (30 mins) for the $20 cover and $4.75 a piece for the beer. If you want more comedy for less doller, then I suggest Theater 99. If you want entertainers and better hosts, go to the Belle.

We went to Il Cortile after the Mike Moran Furniture show at Rebekah Jacob Gallery. Wonderful little Italian place, Sicilian wine by the glass, nice salads, and stellar home-made gnocci. Service seemed a little in the weeds, but there were so many people we knew that kept showing up, we stayed. A great little place on lower King Street to chill and plan the next Italy trip.

The Bourbon Pecan Chocolate Bar was the best sinful pleasure I had during my Charleston jaunt. The coffee drinks & hot chocolates were wonderful as well. With all the Starbucks out there how refreshing to discover a crafted coffee.
To top it off the relaxed urban atmosphere, complete with a library room made it a delight thats mighty delovely.
